These Terms of Service ("Terms") govern your access to and use of the F*IT platform, operated by Zen Window Cleaning Pty Ltd trading as F*IT ("we", "us", "F*IT"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
F*IT is an AI-powered back-office automation platform for Australian trade and service businesses. The Service includes tools for customer relationship management, quoting, invoicing, scheduling, website management, search engine optimisation, phone answering, content production, and advertising management, depending on your subscription tier.
The Service is provided as software-as-a-service. We reserve the right to add, modify, or remove features and to update the Service at any time. We will provide reasonable notice of material changes to features you rely on.
Certain features are available only on specific subscription tiers. Features described on the pricing page are subject to the tier boundaries disclosed at the time of your subscription.
2. Eligibility and accounts
You must be at least 18 years old and capable of entering into a binding contract to use the Service. By agreeing to these Terms you represent that you meet these requirements.
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Ensuring that anyone you add as a user on your account complies with these Terms.
You must notify us promptly at [email protected] if you suspect unauthorised access to your account.
3. Subscription, fees, and billing
3.1 Subscription tiers and pricing
F*IT offers subscription tiers (Lite, Standard, Pro, Dominance, and a Sprint onboarding program). Current pricing is displayed on the F*IT pricing page. Prices are in Australian dollars and include GST where applicable.
3.2 Payment
Subscriptions are billed in advance on a monthly or annual basis, processed by Stripe. You authorise us to charge your nominated payment method on each billing date. If payment fails, we will notify you and may suspend access to the Service after a reasonable grace period.
3.3 Price changes
We may change subscription pricing with at least 30 days' written notice. If you do not wish to continue at the new price, you may cancel before the new price takes effect.
3.4 Third-party costs
Some features involve direct costs with third-party providers that are separate from your F*IT subscription:
- Google Ads: ad spend is billed directly by Google to your Google Ads account. F*IT does not charge for or receive a portion of ad spend.
- Twilio: SMS and voice call charges are passed through at cost or billed directly by Twilio, depending on your configuration.
4. Cancellation and termination
4.1 Cancellation by you
You may cancel your subscription at any time from your account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. We do not offer pro-rata refunds for unused time within a billing period unless required by law.
4.2 Termination by us
We may suspend or terminate your access to the Service if you breach these Terms, if your account is used for unlawful purposes, or if continued provision of the Service is not commercially feasible. We will provide reasonable notice except where immediate termination is necessary to protect the integrity of the platform or other users.
4.3 Effect of termination
On termination, your right to access the Service ceases. We will retain your data for 90 days post-termination to allow export. After 90 days, your data is permanently deleted from production systems. See our Privacy Policy for full retention details.
4.4 Australian Consumer Law
Nothing in this section limits any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010, Sch 2). Consumer guarantees apply where they cannot be lawfully excluded.
5. Acceptable use
You agree to use the Service lawfully and in accordance with these Terms. You must not:
- Use the Service to send unsolicited commercial messages (spam) or to harass, threaten, or deceive any person.
- Use the Service to infringe the intellectual property rights of any third party.
- Attempt to gain unauthorised access to the Service, its servers, or any other system connected to the Service.
- Use automated tools to scrape, extract, or replicate data from the Service without authorisation.
- Introduce malware, viruses, or other harmful code.
- Use the Service in a manner that violates the terms of any third-party service connected to your account (including Google Ads, Twilio, or Stripe).
- Misrepresent your identity or the identity of your business to the Service or to your customers through the Service.
We reserve the right to investigate and take action against any use of the Service that we reasonably believe violates these Terms or applicable law, including suspending or terminating the offending account.
6. Your data and intellectual property
6.1 Your data
You own the data you input into F*IT ("Customer Data"). You grant us a limited, non-exclusive licence to store, process, and transmit your Customer Data solely to operate and provide the Service to you. We do not claim ownership of your Customer Data.
6.2 AI-generated outputs
The Service generates AI-assisted outputs (drafted emails, marketing copy, ad copy, reports, website content). These outputs are produced based on your instructions and data. You are responsible for reviewing AI-generated content before publishing or sending it. We make no representation that AI-generated content is accurate, complete, or suitable for any particular purpose. You retain responsibility for content published or sent through your account.
6.3 F*IT intellectual property
All software, interfaces, methodologies, and content that constitute the F*IT platform (excluding your Customer Data) are owned by or licensed to us. These Terms do not grant you any rights in F*IT's intellectual property beyond the limited licence to use the Service during your subscription.
6.4 Feedback
If you provide us with feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, including improving the Service.
7. Warranty disclaimer and limitation of liability
7.1 Disclaimer
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
AI-generated outputs are produced by probabilistic models. They may contain errors, omissions, or content that is inappropriate for your circumstances. You are responsible for verifying the accuracy and suitability of AI outputs before acting on them.
7.2 Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or your use of the Service will not exceed the total subscription fees you paid to us in the 3 months preceding the event giving rise to the claim.
We will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such damages.
7.3 Australian Consumer Law
Nothing in this section excludes or limits any consumer guarantee or right under the Australian Consumer Law that cannot be lawfully excluded. Where Australian Consumer Law applies, our liability for a failure to comply with a consumer guarantee is limited to supplying the service again or paying the cost of having the service supplied again.
8. Indemnification
You agree to indemnify and hold F*IT, its officers, employees, and agents harmless from any claim, loss, damage, or expense (including reasonable legal costs) arising from:
- Your use of the Service in breach of these Terms.
- Customer Data you input into the Service that infringes any third-party rights or violates any law.
- Your breach of any third-party terms (including Google Ads, Twilio, or Stripe terms) in connection with your use of the Service.
9. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia. You and F*IT each submit to the non-exclusive jurisdiction of the courts of Queensland.
Before commencing legal proceedings, we ask that you contact us at [email protected] with a description of the dispute and your desired resolution. We will make a genuine effort to resolve any dispute within 30 days.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify active account holders by email at least 14 days before the changes take effect and update the "Last updated" date above. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may cancel your subscription before the effective date.
